New Delhi [India], September 20 (ANI): The Supreme Court on Friday refused to transfer the trial in 2015 cash-for-vote case against Telangana Chief Minister A Revanth Reddy outside the state and also accepted his apology on his remarks against the top court decision granting bail to BRS leader K Kavitha.
In the meantime, a bench of Justices B R Gavai and K V Viswanathan directed that not to interfere with the prosecution of the trial in 2015 cash-for-vote case. The top court also directed that the Director General of the anti-corruption bureau (ACB) not to report to Reddy about the prosecution of the case.
The top court also took note of the apology given by Revanth Reddy and closed the proceedings in this relation. When the top court decided not to proceed further on Reddy’s remark but remarked that legislature, the executive and the judiciary mutual respect for functioning to one another.
“Though we do not wish to proceed further in the matter, we may only put on caution all the constitutional functionaries — the legislature, the executive and the judiciary — to discharge their constitutional duties in the spheres earmarked for them by the Constitution. It is expected that three wings of the Constitution show mutual respect for the functioning of each other,” the top court said.
The top court also said that one should be careful enough while making comments about orders of the court, even as fair criticism is welcome but one should not transgress the limits.
Revanth Reddy has issued apology over his statement against the top court order granting bail to K Kavitha. He has also said that petition seeking transfer of trial outside the state as political motivated.
Revanth Reddy reportedly had raised doubts over Kavitha getting bail in five months when Manish Sisodia got it after 15 months and Kejriwal is yet to get it.
The court had earlier said that it is not bothered about someone criticizing but they will keep performing the duties as per the conscience.
The court disposed of the plea filed by Guntakandla Reddy and others seeking transfer of trial from Telangana to Bhopal in Madhya Pradesh
In the plea filed through advocate P Mohith Rao, Guntakandla Reddy said, “That most of the prosecution witnesses were examined in Chief and the Accused No.1 (Revanth Reddy) being the Chief and Home Minister for the State of Telangana can directly influence the de facto Complainant and officers pressurizing them to defer/resile from their earlier statements and further to depose false and there is every possibility that the officers/ de facto Complainant will resile/defer from their earlier statements or will depose false under the threat.”
According to petition, Revanth was former Member of Telugu Desam Party and won the Legislative assembly election for the term 2009-14 and 2014-18 from Kodangal Assembly Constituency, having been elected as Member of Legislative Assembly from Telugu Desam Party.
It was alleged Revanth along with other accused have committed a cognizable offence to lure away the vote bank of Bharat Rashtra Samithi Party (formerly known as Telangana Rashtra Samithi party) and to see that the representative of Telugu Desam Party wins in the biennial election to be held on June 2015.
